These Terms of Service govern your use of the Wellness Care website and services. By accessing our website or engaging our services, you agree to these terms. These terms are governed by the laws of New South Wales, Australia.
1. About Us
Wellness Care Pty Ltd (ABN: 40 672 955 716) is a registered NDIS provider operating in New South Wales and across Australia. We are registered with the NDIS Quality and Safeguards Commission. References to "we", "us", or "our" refer to Wellness Care Pty Ltd.
2. NDIS Services
Our services are provided under the National Disability Insurance Scheme Act 2013 (Cth) and the NDIS Practice Standards. All services are delivered in accordance with:
- The NDIS Code of Conduct
- NDIS Practice Standards
- The Disability Inclusion Act 2014 (NSW)
- The Disability Discrimination Act 1992 (Cth)
A formal Service Agreement will be provided prior to the commencement of supports. The Service Agreement governs the specific terms of your individual supports and takes precedence over these general Terms of Service.
3. Eligibility
Our services are available to NDIS participants with an approved plan that includes the relevant support categories. You or your authorised representative must provide accurate NDIS plan details and inform us of any changes to your plan promptly.
4. Website Use
By using our website you agree to:
- Use the website only for lawful purposes
- Not attempt to damage, interfere with, or gain unauthorised access to our systems
- Not reproduce or redistribute our website content without written permission

5. Pricing & Payment
All services are priced in accordance with the current NDIS Price Guide and Support Catalogue. Prices are in Australian dollars (AUD) inclusive of GST where applicable. Invoices are issued in accordance with your Service Agreement and NDIS plan. Under Australian Consumer Law, you are entitled to a refund or remedy if a service is not delivered as agreed.
6. Cancellations
Cancellation terms are set out in your individual Service Agreement in accordance with the NDIS Short Notice Cancellation policy. Short notice cancellations (less than 2 business days) may be charged at the applicable NDIS cancellation rate. We will always endeavour to work with you if circumstances change.
7. Limitation of Liability
To the extent permitted by law (including the Australian Consumer Law), Wellness Care Pty Ltd is not liable for any indirect, incidental, or consequential loss arising from use of our website or services. Nothing in these terms excludes your rights as a consumer under Australian Consumer Law.

9. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
10. Changes to These Terms
We may update these Terms of Service at any time. The current version will always be published on our website. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.
